Terms and Conditions apply when you use this website and purchase any items from us.

The website www.newyorkdelhi.com (the “website”) is owned and operated by The New York Delhi Company Limited, trading as ‘New York Delhi (“New York Delhi”, or “we”, “us” or “our”).

We are a company registered in England and Wales (registered number 5941042), our VAT number is 919523117 and our registered office and address for correspondence is 1A High Street, Epsom, Surry. KT19 8DA United Kingdom and PO Box 28897 respectively.

By using our website and each time you place an order with us, you are agreeing to these Terms and Conditions, and our Privacy and Cookies Policy. If you do not agree, please do not use our website.

We reserve the right, from time to time, with or without notice, to change these Terms and Conditions at our sole discretion, and the latest version will appear on our website with the date that it was last updated. By using the service after any changes have been posted, you agree to the new terms.

Use of the Website

To register with www.newyorkdelhi.com and purchase goods from our website, you must be over 18 years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering, by updating your personal details. You must give us your real name, address, phone number, email address and any other details that we may require to process your order. Any access codes or passwords provided should be safeguarded at all times. You are responsible for the security of your access codes and passwords and will be solely liable for any use or unauthorised use under such access codes or passwords. We may suspend or terminate your access at any time with or without notice. To understand how we use information collected from you, please read our Privacy Policy.

WE RESERVE THE RIGHT TO:

• Decline a new customer registration or suspend a customer’s account at any time and at our sole discretion
• In our absolute discretion, to terminate your access to all or part of the services with or without notice
• In our absolute discretion, to discontinue the website or services, or any part thereof, at any time, with or without notice

Availability

Goods are subject to availability.
Our acceptance of your offer to purchase our goods is subject to their availability. Our acknowledgement of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods within the times given on the site during the order process. which you have offered to purchase, we will let you know as quickly as possible and a full refund will be given. Note that during peak periods we have the right to extend normal lead times.

Pricing, Description & Product Information

The prices which you must pay for the products that you order are set out on the website at the time you place your order, except where we discover an error in the price of the products you have ordered. In this event, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. The prices quoted on this website apply only to products sold via this website.

Where the same products are available via another stockist different prices may apply. All prices are shown in £ sterling and include VAT where applicable. Although we will take all reasonable care to ensure that all descriptions, images, details and prices of products appearing on the website are correct at the time when the information was entered onto the system, the information appearing on this website at any time may not reflect the exact position at the moment you place an order. All measurements and sizes are approximate, although we make every effort to ensure that they are as accurate as possible. There may also be variations in colour from the image shown online.

Placing an Order & Order Acceptance

The Order Acknowledgement email and order number are our confirmation of your order with us.  Completion of the contract between you and us will take place on dispatch to you of the products ordered, unless we have notified you that we do not accept your order, or you have cancelled it.  Our carrier will make every reasonable effort to contact you to make delivery, but, if they are unable to do so, then your order will be cancelled, and payment refunded to your card.

Membership – The Site is available to registered users who are 18 years and older and who have not been suspended or removed by us for any reason (a “Member”). We reserve the right to revoke your membership for any reason at any time including as a result of a violation of these Terms or the Privacy Policy, without notice. Where we revoke your membership, this will not affect current orders which we have acknowledged unless we revoke as a result of your breach of these Terms or the Privacy Policy or any other guidelines or rules, in which case we may terminate all existing orders and will not be obliged to make any refund.

Orders and Contracts – Products may be ordered by clicking on the box or item you wish to purchase and then following the prompts that will appear on-screen. You may check and correct any input errors in your order up until the point at which you submit your order to us by clicking the “Checkout” button on the checkout page.

Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us. We are not obliged to accept your order and may, in its discretion, decline to accept any order. Where we accept an order, it will confirm such acceptance to you by sending you an email that confirms that the product has been dispatched.

Prices include VAT, and delivery costs (where applicable) will be added when you view the items in your shopping basket. Your order will be fulfilled by the delivery date set out in the confirmation email or, if no delivery date is specified, then within a reasonable time of the date of the order. Membership is void where prohibited by law.

Consumer Rights and Cancellation – You may cancel your first order and receive a refund at any time before your order is delivered and up to fourteen days afterwards, beginning on the day after you receive the products. In this case, you will receive a full refund of the price paid for the products in accordance with our refund policy (see below).

To cancel your order, you must inform us by email, giving us your name, address and order reference. You must return the products to us within 14 days of notifying us of the cancellation in the same condition in which you receive them and at your own cost and risk. We have the right to deduct from your refund amount any reduction in value of the products caused by your handling of the products beyond what is necessary to establish the nature, characteristics and functioning of the products.

New York Delhi’s refunds policy is: if you cancel an order within the fourteen-day cancellation period (see above), we will refund you as soon as possible and, in any case, within fourteen days of the day of our receipt of the returned products or (if earlier) the day you provide evidence of having sent the products back to us. We will refund the price of the products in full excluding the cost of delivery. We will refund the purchase price using the same method originally used by you to pay for your purchase.

Dietary Information – The products included in our boxes and on our site, are made in the same environment as nuts, peanuts and sesame seeds and therefore we cannot guarantee that they are free from nut, peanuts or sesame seeds traces. Payment

We take payment from your card at the time we receive your order, once we have checked your card details and stock availability. Payment must be made with a valid credit or debit card acceptable to us. Where you have input a different delivery address to registered card address, we reserve the right to refuse the order where we suspect fraud or otherwise breaking these terms. You can register a new payment card at any time, but the card associated with a given order cannot be changed once you have checked out.

Delivery

Provided that we have processed and received payment in full for the products, ownership of an item will pass to you once we have delivered the item to you (either directly, or by leaving it in a safe place or with a neighbour). When an item has been delivered, risk of damage to, or loss of, the item passes to you. For specific delivery options, including international order delivery, please read our delivery section.

Whilst we take every care to ensure that deliveries are protected to prevent damage in transit, we cannot guarantee that parcels being sent to areas outside of the European Union and mainland UK will arrive in perfect condition. Please note that working days for us are Monday – Friday and do not include English bank holidays.

Cancellations & Returns

This includes your right to cancel your order under the distance selling regulations. You will receive a full refund including the original postage and packaging for the order if the charge was levied with your original order and it is returned in full. If your order has already been dispatched please refer to our returns information. We hope you are happy with any product purchased, but if you wish to return a product to us for any reason you may do so within 30 days of the dispatch date. It must be in a saleable condition and in its original undamaged packaging. We will refund the price or replace the product. Return delivery charges will only be refunded in the event of faulty, damaged or incorrect items being sent to you. This does not affect your statutory rights. Other than for defective products, returns outside the timeframe set out above may be accepted at the sole discretion of New York Delhi.

Refunds & Exchanges 

All refunds will be made to the debit or credit card on which the original purchase was made, within 30 days of the cancellation of the order or return of the goods. In the event that New York Delhi is unable to credit your original method of payment, we will contact you to arrange an alternate method of refund. On faulty products, after the 14 day cancellation period. We also reserve the right to offer a replacement item of similar or equal value.

Promotions & Discounts

In order for a promotion or offer to be applied to your order, a valid promotion code must be entered into the promotion code box on the basket page. New York Delhi cannot be held liable for not discounting the order if a valid code has not been entered. Promotions and promotion codes are subject to the terms and conditions specified by New York Delhi at the point of purchase. Only one code can be used per order.

Please note: Discount codes will not apply to any existing offers or promotions.

Website Changes & Updates

In order to keep our website as accurate and as up to date as reasonably possible, it may be necessary, from time to time, to restrict access to the site in order to undertake necessary maintenance work. We will make every effort to ensure that any down time or restricted access is kept to a minimum. Registration data and certain other information about you is subject to our privacy policy.  We recommend that you read our Privacy Policy before you accept these terms and conditions.

Intellectual Property & Copyright

The content of www.newyorkdelhi.com website is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the website on a computer screen, store such content in electronic form on disc (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the website without written permission from New York Delhi.

Limitations

This website and any software are provided on an “as is” basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement.

Indemnity

You agree to indemnify and hold New York Delhi harmless from all liabilities, claims and expenses that arise out of the content you submit, post or transmit via the New York Delhi website, or from your use/misuse of the website, or the use/misuse by any person for whom you are responsible or from your violation of the terms and conditions.

Governing Law

The contract between you and New York Delhi under which you have made your purchases, it is agreed, shall be governed by, and interpreted in accordance with, English law. The English courts shall have jurisdiction to resolve any disputes between us. This does not affect your statutory rights.
